Criminal Defense Investigations

crim def 3_edited_edited_edited.jpg

We accept public defender cases as well as private, and assist attorneys by gathering evidence to support a defendant accused of a crime. The goal is to find facts that create reasonable doubt by challenging the prosecution's case, identifying inconsistencies, or uncovering new evidence that law enforcement may have overlooked.

We provide an independent perspective to ensure the accused receives a fair trial and that all relevant information is considered. Our investigations help level the playing field against the resources of the government and law enforcement.

A thorough defense investigation may include the following steps:

  1. Investigative Case Review and Analysis: The investigator works with the defense attorney to review the initial charges, police reports, and the case file provided through discovery. They will identify the elements of the crime and the prosecution's theory.

  2. Defendant Interview: The investigator conducts a comprehensive interview with the client to understand their account of events. This is a critical step, as the defendant can be the best source of information for leads and exculpatory evidence.

  3. Crime Scene Examination: The investigator may independently examine the crime scene to take new photographs, note details, or reconstruct events. This can provide a critical new perspective that might contradict the prosecution's narrative.

  4. Witness Interviews: Defense investigators interview witnesses to obtain their statements. They may also uncover new witnesses unknown to the police or those whose statements were incomplete.

  5. Background Investigations: A crucial step is performing background checks on witnesses and the alleged victim to uncover information that could be used for impeachment at trial, such as bias or prior inconsistent statements.

  6. Evidence Analysis and Collection: This involves scrutinizing evidence collected by the police and looking for new evidence. It can include forensic analysis of physical evidence, reviewing documents, or searching public records.

  7. Report and Testimony: The investigator prepares a detailed report of all findings for the defense team. In some cases, the investigator may be called to testify in court as a defense witness.
